Title : FDP-NIH Specific Requirements Type : Grant Conditions NSF Org: OD / LPA Date : April 17, 1996 File : fdpnih ***************************************************************** Note: No substantive changes made, reformatting of data only. ***************************************************************** FDP - NIH AGENCY SPECIFIC REQUIREMENTS The General Terms and Conditions of the Federal Demonstration Project are modified as indicated below: Identification of the Cognizant Awarding Agency Officials The NIH Grants Management Officers of each appropriate awarding component are the Officials to be notified when required by the General Terms and Conditions. Article 2. Allowable Costs and Prior Approvals Direct Costs: As reference in item a. and b. The allowability of direct costs not specifically covered by the provisions of OMB Circulars A-21 or A-122 as appropriate shall be in accordance with the PHS Grants Policy Statement, or Department of Health and Human Services or NIH announcements, if more current. Indirect Costs: Indirect costs shall be reimbursed in accord with the provisions of the PHS Grants Policy Statement. The latest revisions of OMB Circular A-110 and the DHHS regulations at 45 CFR Part 74, Administration of Grants, allow Federal agencies to waive certain cost related prior approvals for awards that support research (Expanded Authorities). Accordingly, NIH applies and implements all of the Expanded Authorities (EA) provisions to FDP institutions. NIH applies EA to; Program Project grants (P01), Research Career Awards (Ks), Minority High School Student Research Apprentice Program Awards (SO3) and all Research Project grants (Rs) except phase I Small Business Innovation Research (R43) and Small Business Technology Transfer (R41) awards. (A complete listing of NIH grant award mechanisms to which EA apply is attached.) Article 5. Significant Project Changes The grantee organization is required to seek approval when there is a significant change in the scope or research objectives of the project. An example of a possible indication of such change is a significant rebudgeting action. Significant rebudgeting occurs when expenditures in a single direct cost category deviate (increase or decrease) from the categorical commitment level established at the time of the competing award by more than 25 percent of the total amount awarded or $250,000 whichever is less. The basis for determining significant rebudgeting excludes the effects of carryover of prior year unobligated balances, but includes competing or administrative supplements. It should be noted that this redefines the term significant rebudgeting as stated in the PHS Grants Policy Statement (rev. April 1, 1994) pages 8-1 and 8-7. Article 6. Non-Competitive or Continuation Award Requirements. NIH grant recipients are expected to use the streamlined noncompeting continuation application process (SNAP) for R01, R03, R13, R15, R18, R21, R24, R25, R29, R37, R42, R44, and the "K" series mechanisms. Instructions for submitting the streamlined noncompeting application are included in the PHS 2590 (Rev. 5/95) under A. Simplified Instructions, page 2. Additional information concerning SNAP will be made available through the NIH Guide. Article 7. Financial Reports In item a. the cognizant awarding agency official is the Grants Section, Federal Assistance Accounting Branch, National Institutes of Health, Building 31, Room B1, B11, Bethesda, Maryland 20892. NIH urges recipients to transmit data by electronic mean whenever possible. Article 21. Unobligated Balances and the Limit of Federal Liability In item a. the first sentence is changed to read, "Except for funds restricted on a Notice of Grant Award, grantee organizations are authorized to carry over unobligated funds remaining at the end of any budget period." In item b. grantees are to reflect the amount of unobligated balances carried over in item 12, "Remarks," of the Financial Status Report. When a grantee reports on the FSR balances of unobligated funds in excess of 25 percent of the total amount awarded, or $250,000, whichever is less, NIH staff shall review the circumstances resulting in such balances and take appropriate action. Article 22. Patents and Inventions The NIH point of contact for communications on matters relating to the Patents Rights (Small Business Firms and Nonprofit Organizations) clause at 37 CFR 401.14 (51FR25517, et seq., July 14, 1986, or any subsequent amendment in effect as of the beginning date of the award) is the Office of Policy for Extramural Research Administration, NIH. Article 26. Nondiscrimination The HHS and PHS regulations implementing the statute under this article are incorporated by reference to the PHS Grants Policy Statement on the Notice of Grant Award. PHS Regulations and/or Administrative Requirements Grant Closeouts: to be processed in accord with the provisions of the PHS Grants Policy Statement as found on page 8-24.
